Charles A. Hornewer and Terrence M. Quinn, partners with the firm with the firm of Phillips Law Offices have received a Five Hundred Thousand Dollars ($500,000) Settlement for a woman suffering complications of Gastric Bypass Surgery.

The Plaintiff, a 48 year old woman, had gastric bypass surgery and was discharged from the hospital while still having terrible pain. At her postop clinic visit, the doctor did not examine her and her stitches were removed by a nurse. A week later, she returned to the emergency room in severe pain and was found to have an infection as a result of a biliary leak left over from surgery. She was treated for months for biliary peritonitis, an infection that resulted from the bile leak following surgery. We alleged that our client should not have been discharged from the hospital after her surgery without the doctors investigating the source of her continued pain. Also, we alleged that it was a deviation from the standard for the physician not to have examined her personally when she appeared at the clinic. The defendant did not offer any settlement until the case was fully prepared for trial and trial was imminent.
