On March 20, 2003 Plaintiff went to a hospital for spine surgery. He had a long standing history of spine problems and four prior spine surgeries. He had post-surgical complications related to his pre-existing lung disease and had difficulty breathing.

Plaintiff was taken from his room to have an MRI performed. While in the MRI room, Plaintiff’s tracheostomy tube became dislodged and his airway was closed off. The respiratory therapist, nurse, and resident physicians caring for him could not re-establish an airway and the Plaintiff passed away.

 

The Plaintiff left surviving him a wife and two adult children, one of whom he was estranged from and the other he had just recently re-established contact with.
