$1,500,000 SETTLEMENT TO POLICE OFFICER WITH COMPLICATIONS FROM BACK SURGERY
A 48 year old police officer who experienced complications after back surgery will receive a $1,500,000.00 settlement in a medical negligence case. After falling and injuring his back while chasing a suspect, a police officer was scheduled to undergo spinal surgery, wherein a medical device known as a Harm’s Cage was implanted. When he continued to experience pain and nerve involvement after surgery, it was discovered that the disc space had collapsed around the device because it was improperly place within soft cancellous bone within the disc space. This collapse caused impingement of the discs onto his nerves and he had to be re-operated to reconstruct and fuse the area. Despite the subsequent surgeries, he continued to experience pain and it was determined that other than pain management, nothing more could be done to correct the problem. The law suit, _______ v. JESSE BUTLER, MD and ILLINOIS BONE & JOINT INSTITUTE, was pending before Judge Daniel Locallo, who has dismissed the medical malpractice case pursuant to the settlement agreement. The plaintiff was represented by Charles Hornewer, a partner at the personal injury firm of Phillips Law Offices.
